TERMS & CONDITIONS
For the purpose of this document, “Us”, “We” or “Our” refers to the company Bubble Brothers and associates (ABN 27392752115). ‘You’ and ‘your’ refers to the parties involved in the booking, communications and participation in the events whether as a player or observer.
1.0 BOOKING CONFIRMATION
1.1 All bookings will be confirmed via email once have agreed with these terms and conditions and an initial minimum deposit of 20% of the total booking fee is paid (see clause 3.1).
1.2 If we do not receive the deposit and/or you do not agree with the terms and conditions, no booking will be made.
2.0 WAIVER FORM
2.1 Individuals are restricted from play unless our waiver form has been filled out and handed to the staff on game day or sent via email.
3.1 A minimum deposit of 20% of the total booking fee is to be made at confirmation of booking. Payment can be made by bank transfer. Please pay via the details sent in our invoice, which will be sent via email.
3.2 Final payments are due within 48 hours of the commencement of the booking. In the event payment is not received in this time the deposit will be forfeited.
4.0 CANCELLATION & REFUND
4.1 Cancellation by you: All un-recoverable venue hire deposits or fees are non-refundable. If cancellation occurs 7 days or more before the date of booking, and is due to reasonable circumstances the deposit (and any other associated recoverable payments) will be fully refunded. This does not include cancellation due to changing your mind, insisting services provided in a particular way against our advice, or failing to explain needs to us (the provider). See here for more information. If cancellation occurs less than 7 days but more that 48hrs before the booking time the deposit will be forfeited. If cancellation is made less than 48 hours before the booking time of 50% of the total booking fee will be charged and left over will be refunded. In case of a no-show no refunds will be available.
4.2 Cancellation by Indoor Venue or Council
In any case of cancellation by the indoor venue and has been organised by us, you will have the options of either a full refund or to re-schedule the game.
4.3 Cancellation by Major Event/Weather
In the case of extreme weather, we will notify you prior to the event, at this time it is up to you whether to continue with the booking, cancel or re-schedule (cancellation will result in full refund). If the client decides to pursue the game and later cancels, then only a re-scheduling is available – no refunds are available. At any time we reserve the right to cancel any game if it is determined that weather conditions are unsuitable for bubble soccer.
4.4 Cancellation by us
At any time if we determine that it is not in our best interest for us and/or you to continue with your booking, we reserve the right to cancel any booking. If this occurs you will be given the option of a full refund. At our discretion you may also be given a secondary option of re-scheduling your booking
4.5 Breach of terms and conditions
Any breach of our terms and conditions will result in the cancellation of your booking immediately. Refunds will be made at our discretion.
5.0 LOSS AND DAMAGES
5.1 You are responsible for any loss of property, damage or expense caused to property owned by us and/or the property of other clients, venue, guests or general public at the event due to negligent actions by you or your party.
5.2 You agree to repair or rectify any damages caused by negligence to any equipment owned by us; and to cover any additional costs that may occur.
6.0 VENUE ORGANISATION
6.1 If we organize a venue for you, we will email you the venue information with your booking confirmation.
6.2 If you have your own venue, the venue must be suitable to host a Bubble Soccer game. It is up to you to confirm with us that your chosen venue is suitable.
6.4 The approval of the venue is at our discretion.
6.3 The usual set-up and pack down time is 30 minutes. If you are booking your own venue please ensure that we have access to the venue within these time limits.
6.4 If you are playing in a public park it is your responsibility to obtain permission from the council. Public spaces work after the principle of first-come-first-serve unless booked by sports teams. Some public parks use is at the discretion of council rangers. Please refer to cancellation policy clause 4.2 if a ranger stops a game.
7.0 GAME SAFETY AND BUBBLE SOCCER RULES
7.1 Bubble Soccer Rules and Games Safety Guidelines are as follows:
All safety decisions and rules are at the discretion of the staff member on the day. Their say is final. When a player is down, you must give them space and time to get back up. You must not bump into or jump on a player that is down. You cannot charge into any player who does not have a suit on. No purposeful contact should ever be made to the bubble with your feet.
8.0 CODE OF CONDUCT
8.1 Our staff members have final say in all decisions.
8.2 Proper clothing must be worn at all times while participating in our activities. Only flat-soled enclosed shoes may be worn (No cleats or sandals). No jewellery or any other accessory that may injure you or damage the bubble suit. Pants are permitted but we suggest shorts or other workout gear as you will get hot and sweaty while in the bubble suit.
8.3 Players are not allowed to kick the bubbles at any time. We realize that, on occasion, when you are on the ground, your feet may come in contact with another bubble, but please refrain from kicking it or rubbing your shoes against it.
8.4 Players will not be permitted to participate in any bubble activities under the influence of alcohol or drugs. Any player that does so unbeknownst to our staff does so at their own risks and takes full responsibility for any consequences that may arise as a result of such.
8.5 Excessive swearing and/or inappropriate or rude comments will not be permitted. We understand some may slip, especially with the nature of the activity, but try to be respectful of the people around you.
8.6 Any purposeful attempt to pop or damage the bubble suits will result in an immediate removal from the activity and participant will be banned from using them again. Participant will also be required to pay for the cost of fixing or replacing the bubble suit.
8.7 We recommend that each participant has personal insurance and a physical before participating in any physical activity such as bubble soccer.
8.8 Players that are not in a bubble are not allowed to push, shove, or bump into another player that is in a bubble due to safety reasons.
8.9 Players must sign a Waiver before participating in any bubble activity.
8.10 Purposeful and excessive contact is not permitted in any activity. Contact is part of our game and is generally permitted, however we define ‘excessive’ contact as any action which is designed to either injure another player or damage our equipment. This contact is not permitted and any player found acting in this way will be immediately be disqualified from play.
